A Federal High Court has struck out one of five suits challenging the eligibility of President Goodluck Jonathan to contest the 2015 general election.
Justice Ahmed Mohammed struck out the case filed by one Prof Tunde Samuel and three others, following a request by their counsel, Mr Yusuf Alli, that his clients have decided to withdraw their suit against the president .
With no opposition to the motion by other parties in the suit, Justice Ahmed Mohammed obliged the request, but not without awarding damages to the President in the sum of N50, 000.
Professor Tunde and his co-plaintiff had approached the court to disqualify President Goodluck Jonathan from contesting the election on the ground that he has been in office for six years and should he win the election, he would spend ten years in office, a situation not recognized by law in Nigeria.
The withdrawal of this suit reduces the cases challenging the eligibility of President Goodluck Jonathan to contest the 2015 general election to four, with the other two pending at the Appeal Court and two others at the Federal High Court .
